Development and Building Permit Requirements
Please be advised that Provincial Legislation (Building Standards) under The Construction Code Act requires that all municipalities in Saskatchewan must have adopted, administer, and enforce a Building Bylaw, and appoint a Building Official.
The new Construction Code Act in Saskatchewan was adopted by the provincial government, and came into effect January 1, 2022. This legislation requires that all municipalities in Saskatchewan must adopt, administer, and enforce a Building Bylaw, and appoint a Building Official. Therefore, requiring that each municipality regulate the construction requirements of all buildings in Saskatchewan, as the building use pertains to The Construction Code Act.
Municipalities were notified of the new legislation in 2022. Those municipalities who did not have a Building Bylaw, or were not enforcing their Building Bylaw (requiring building permits, construction review, and inspections by a licensed building official) were notified that they needed to initiate the steps to be compliant.
As stated in Bylaw No. 03-2023, the following require a building permit: Single Family Dwelling (Stick Built), Single Family Dwelling Additions, Ready to Move Homes (RTM – with garage), Ready to Move Homes (no garage), Detached Garage, Mobile Homes, Decks over 3 feet in height and Basement Developments. The application of the permit triggers review and confirmation by a licensed building inspector, to ensure that the construction is being built in a way that adheres to the building codes.
Development (all new developments) and Building Permit Applications can be obtained by contacting the R.M. of Fertile Valley No. 285 or stop by the RM Office in Conquest (Monday to Thursday). The municipality currently contracts Municode Services based out of Warman, as our licensed building officials. The cost of the Building Permit is dependent on the value of the proposed construction. The RM charges the applicant the cost of the building inspector fees for each project. Therefore, no municipal revenue is currently being generated through the requirement of building permits.
Building permit applications need to include a drawing of your property showing where on the property the buildings are currently located, and the new construction is planned to take place, as well as the distance from the proposed building to the edge of your property lines. In many cases, engineered building plans and drawings may also be required.
All property owners in the R.M. of Fertile Valley No. 285 who may be considering any building construction, are encouraged to contact the municipality’s Building Inspector Municode, prior to beginning construction. Simply ask to speak with one of the building officials, and they would be happy to talk to you about your specific project, and what type of building standards/engineering may be required for the construction. Therefore, you can have that information in advance of applying for a Development and Building Permit. Municode may also be able to provide you with different options regarding construction methods. No building construction is to take place without the approval and issuance of a Building Permit.
Regulating and enforcing building construction is not something the R.M. of Fertile Valley No. 285 municipal staff and elected officials want to do, but as per provincial regulation it is required. Therefore, as required by legislation, failure to comply with building permit and construction code requirements may result in further action and enforcement by the R.M. of Fertile Valley No. 285, and their building officials. It is in everyone’s best interest to be proactive in their construction plans, and obtain a development and building permit prior to commencing any building construction.
